📄 Abstract(原文)

The European Union's Carbon Border Adjustment Mechanism (‘CBAM’) has entered its definitive phase and, in doing so, signals a broader shift in global economic governance: the extension of domestic climate policy through trade instruments applied at the border. Framed as an anti-carbon-leakage measure directed at steel, cement, aluminium, fertilisers, hydrogen and electricity, CBAM's normative reach nonetheless extends into maritime supply chains, where it interacts with the EU's own extension of the Emissions Trading System to shipping and with the International Maritime Organization's stalled Net-Zero Framework. This article examines that interaction through three intersections: first, the overlap between CBAM's treatment of embedded emissions and the parallel maritime EU ETS; second, the jurisdictional and temporal friction created by the postponement of IMO adoption to October 2026; and third, the cascading structural impact on ship-owners, charterers, freight forwarders and shipbuilders. Using doctrinal and comparative legal analysis of the CBAM Regulation as amended, the ETS Directive, FuelEU Maritime and IMO instruments, the article argues that CBAM's long-term legitimacy in the maritime context depends on its evolution from a unilateral trade measure into a catalyst for interoperable carbon pricing that credits equivalent measures taken elsewhere.
