📄 Abstract(原文)

Chapter 9 is written by Fahira Brodlija and is titled ‘Reforming Investor–State Dispute Settlement (ISDS) Procedure for Energy Transition Disputes: From Obstacle to Tool for Sustainable Development.’ The author highlights that ISDS has been an ‘easy target’ for critics of the investment treaty landscape. This critique has exacerbated in times of urgent calls for energy transition to combat climate change and elevate environmental standards. The author rightly notes that the procedural critique goes to the very heart of the investment treaty system, namely, ‘questioning whether foreign investors should be able to challenge government measures for energy transition, and if so, what format and guardrails (if any) should they have in the future’. Against such background, this chapter analyzes and dissects a spectrum of proposed and implemented reforms, placing them in the energy transition context, and suggesting possible mechanisms for their effective use. The chapter eloquently moves between those suggestions advocating for termination of ISDS, to those advancing it as a premium feature of global energy and foreign direct investment (FDI) governance. In doing so, she focuses on reforms in individual States, as well as international joint efforts (primarily the UNCITRAL WG III). The author presents a balanced, informed, yet firm, voice against the anti-ISDS movement while offering workable reform solutions to redress current shortcomings of the system design.
